Applicable Laws

This site is controlled and operated by Life Names and Tumbler Ridge Chamber of Commerce from its offices within the province of British Columbia, Canada. Life Names and the Tumbler Ridge Chamber of Commerce make no representation that the Materials are appropriate or available for use in other jurisdictions, and access to them from jurisdictions where its contents are illegal is prohibited. Those who choose to access this site from other jurisdictions do so on their own initiative and are responsible for compliance with applicable local laws. You agree that the laws of British Columbia and Canada apply to any issue which may arise relating to the Materials, and to settle such disputes in the courts of British Columbia, Canada.

Payments

You shall pay for the services, software, membership fees or upgraded website listing fees in accordance with the listed or invoiced charges, within thirty (30) days of the date of the invoice received from either Life Names or the Tumbler Ridge Chamber of Commerce, or within 30 days of submission of the membership registration form online at tumblerchamber.com/registration

All invoices not contested in writing within fifteen (15) business days of receipt are deemed accepted by you as true and accurate and are payable in full. Interest will be charged on all accounts not paid when due at a rate of two percent per month, or, if less, the maximum rate allowed by law.

In the event you fail to pay Life Names and the Tumbler Ridge Chamber of Commerce all amounts which become due under the Service Agreement or fail to perform your obligations hereunder, and you refer such matters to an attorney or collection agency, you agree to pay, in addition to the amounts due, any and all costs incurred by Life Names and the Tumbler Ridge Chamber of Commerce as a result of such action, including reasonable attorney’s fees. Life Names and the Tumbler Ridge Chamber of Commerce have the right to charge a return check fee or a fee to restart membership if the Customer is shut off for poor pay history. Life Names and the Tumbler Ridge Chamber of Commerce reserve the right to cancel any service provided to you at their discretion in the event payment is not made or in case of any other violation of these terms and conditions.

Delays to Service

The listing of your business in our member directory may take up to ten business days from the date all the information and materials required are received. Life Names and the Tumbler Ridge Chamber of Commerce will not be held responsible if exceptional circumstances cause the further delay of providing our service to you or for other interruptions in the service throughout your service period.

On-Line Payments

1. Using the online payment facilities on our website indicates that you accept these terms. If you do not accept these terms do not use our online payment facilities. All online payments are subject to these conditions.

2. Your payment will normally reach the Tumbler Ridge Chamber of Commerce or Life Names account within two working days. We cannot accept any liability for delayed payments.

3. We cannot accept liability for payments being recorded on the wrong account if you supply inaccurate information, but will make every effort to reallocate any such payments if they arise.

4. We cannot accept liability if payment is refused or declined by your credit/debit card supplier for any reason.

5. If your card supplier declines payment, Tumbler Ridge Chamber of Commerce or Life Names is under no obligation to bring this fact to your attention. You should check with your bank/credit/debit card supplier that payment has been deducted from your account.

6. The data that you provide during online payment transactions is securely held by Stripe Inc. or our e-commerce provider in accordance with the PCI Data Security Standard (PCI DSS) and will only be used for the purpose of recording your payment and for accounting processes. Your data will be treated confidentially and with the utmost care and respect. Your data is used for no other purposes and is disclosed to no third party, except in respect of data that it is necessary to provide to Tumbler Ridge Chamber of Commerce’s or Life Names e-commerce provider who will process this information on Tumbler Ridge Chamber of Commerce’s behalf. In limited, exceptional circumstances, Tumbler Ridge Chamber of Commerce or Life Names may be required to disclose data to other third parties, for example where this is necessary to comply with the law. Our e-commerce provider will retain some personal information so that we can access payment records in the event of queries or incomplete payment information. Any credit or debit card details given by you will not be retained in their entirety. Information will only be retained for a reasonable period and then destroyed securely.

7. In no event will Tumbler Ridge Chamber of Commerce or Life Names be liable for any damages whatsoever arising out of the use, inability to use, or the results of use of this site, any websites linked to this site, or the materials or information contained at any or all such sites, whether based on warranty, contract, tort or any other legal theory and whether or not advised of the possibility of such damages.

8. Refunds, if applicable, will be made to the debit/credit card or bank account used for the original transaction. Any refunds will be made in line with Life Names and Tumbler Ridge Chamber of Commerce anti-money laundering policy and procedures.
